Building a Deck

Building permits are required for decks (located in the rear, front or side yard) where there is a difference in elevation of more than 0.6 m (23 5/8") between the walking surface and adjacent ground and/or structurally attached to the house or any other building with a foundation.

Be advised that all decks are required to meet the provisions set out in the Zoning By-law.

Permit Fee

The building permit fee is $115.00 (Item 11, Section A of Schedule 'A' to Building By-law No. 45-2014).

Only cash, cheque or debit is accepted.

Zoning Requirements

The following is a comprehensive zoning chart for determining the required setbacks that shall be determined in locating the deck on the property.

Building Requirements

Footings

Concrete block footings are only allowed when all of the following requirements are met:

  • Deck area is not more than 55 m² (592 ft²).
  • Deck does not support a roof.
  • Deck is freestanding and not attached to another structure.
  • Distance from the finished ground to the underside of the floor joists in not more than 0.6 m (23 5/8").

Where deck blocks are not allowed concrete piers (sonotubes) are required and shall be minimum 1.2 m (4'-0") below finished ground, concrete pier diameters vary according to the supported deck area, refer to the deck guide.

Guards

A guard is required when there is a difference in elevation of more than 0.6 m (23 5/8") between finished ground and the top of the decking.

Guards for decks less than 5'-11" above finished ground are allowed to be 0.9 m (3'-0") high. All other guards shall not be less than 1.07 m (3'-6") high.

Engineered guards (i.e. aluminium, glass, etc) must comply with the Ontario Building Code (OBC). Not all products sold in Ontario comply with the OBC; it is advised that before purchasing a guard system to contact the manufacturer to determine this. When applying for a building permit you are required to submit the specifications and connection detail showing compliance, failure to do so will delay the permit process.

To submit a complete permit application the following items are required:

All drawings shall be fully dimensioned, drawn to scale on minimum letter sized paper. Note all sizes and types of construction materials to be used and their respective locations, include stairs location.
