Notice of Repealing By-law

Repeal of By-law Number 52-2020 (Zoning By-law Amendment Application Z2/19) 221, 271 & 321 Church Street South

This notice is to advise of a repealing by-law being considered by Town of Ajax Council at its meeting on Monday, October 21, 2024 at 1 p.m.

The intended purpose of the proposed repealing by-law is to repeal By-law Number 52-2020 which was passed by Town of Ajax Council on December 7, 2020 to implement Zoning By-law Amendment Application Z2/19 to regulate the future development of the subject lands, municipally known as 221, 271, and 321 Church Street South. However, By-law Number 52-2020 was appealed to the Ontario Land Tribunal, and following the appeals, the Ministry of Municipal Affairs and Housing issued a Minister’s Zoning Order (O. Reg. 773/21) on November 15, 2021 to regulate the future development of the subject lands, reflective of By-law Number 52-2020.

The subject lands have been developed in accordance with the Minister’s Zoning Order (MZO) and all necessary approvals (approval of Site Plan Application SP1/22) and building permits have been issued.

By repealing By-law Number 52-2020, the appeals will be withdrawn and the MZO regulating the subject lands will remain in full force and effect.

A copy of the staff report and repealing by-law will be available by end of day on Tuesday, October 8, 2024 in the agenda for the October 15, 2024 General Government Committee meeting, available at ajax.ca/meetings. Alternative formats of documents and materials can be made available upon request in order to assist those who require accessibility accommodations.
